Recent Conclusions of the Advocate General on the Agreements between the EU and Morocco: Conclusions and Suggestions / Sahara

The progress made in the appeals brought by the EU Council and the European Commission against the ruling of the Court of First Instance concerning the agricultural and fisheries agreements with Morocco is described in full in the most recent conclusions of the Advocate General of the Court of Justice of the European Union.

It is crucial to remember that these findings are merely the first steps in a longer process. The Advocate General stressed the significance of upholding the legality of Morocco and the EU's agriculture agreement, as well as the consequences for the fisheries agreement and Morocco's goals to bring this partnership up to date. Additionally, she refuted the assertions made by the "polisario" representative and affirmed the EU's authority to reach agreements with Morocco that pertain to its southern provinces.


Given the critical nature of this issue, European institutions must assume responsibility for safeguarding this cooperation from any political manipulation or procedural wrangling.


The denial of the "polisario" representative's claims also highlights the necessity of elucidating the political and legal underpinnings of the "Western Sahara" issue. This serves to uphold Morocco's authority to negotiate with the EU on these issues and to bolster the legitimacy of the agreements it has reached.


Furthermore, the Advocate General suggests that the Court of First Instance's decision be overturned and that the agricultural agreement between Morocco and the EU be upheld, therefore attesting to the deal's legitimacy. Her recommendations also draw attention to the fact that neither the EU nor the UN recognizes the "polisario" as the exclusive representative of the people of "Western Sahara". In addition, she opposes a request to forbid EU imports of agricultural products from the Southern provinces, opening the door for ongoing trade in this area between Morocco and the EU.
